AGREEMENT TO OUR LEGAL TERMS

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and dasha tapes Design & Artwork Services ("Company," "we," "us," or "our"), a company registered in the United Arab Emirates.
We operate the website https://tapesacademy.com (the "Site"), together with any related products or services that reference these Legal Terms (collectively, the "Services").

Our Services consist of downloadable digital photobook templates that customers can personalize with their own photographs for personal printing. All products sold through the Services are digital products delivered electronically. No physical products are sold or shipped.

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree with these Legal Terms, you must discontinue use of the Services immediately.
We may update these Legal Terms from time to time. Changes become effective immediately upon publication on the Site. Your continued use of the Services constitutes acceptance of the revised Legal Terms.

The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

1. OUR SERVICES
The Services provide downloadable digital photobook templates designed for personal customization.
No physical goods are sold or shipped.
Following successful payment, customers receive access to download their purchased digital products electronically. Delivery may be provided through secure download links, including links hosted on Google Drive or another third-party file hosting service selected by us.

Your purchase is considered fulfilled once the download link has been successfully delivered to the email address provided during checkout or otherwise made available to you.
Customers are responsible for downloading and securely storing their purchased files after delivery.
Although we make reasonable efforts to maintain file availability, we cannot guarantee uninterrupted availability of third-party hosting services.
The Services are not intended for any use that violates applicable laws or regulations. All templates, layouts, graphics, designs, text, logos, website content, branding, and other materials available through the Services are owned by or licensed to us and are protected by copyright.

2. INTELLECTUAL PROPERTY RIGHTS
Our Intellectual Property

All templates, layouts, graphics, designs, text, logos, website content, branding, and other materials available through the Services are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
Purchasing a digital template grants you a limited license to use the template for personal purposes only. Ownership of the template and all intellectual property rights remain with dasha tapes Design & Artwork Services.

License to Use Purchased Templates
When you purchase a digital template, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  download the purchased template;
  customize it using your own photographs;
 create printed copies for your own personal, non-commercial use
  print one or more copies of your completed photobook for your personal, non-commercial use, either at home or through a professional printing service.

You may not sell, share, redistribute, sublicense, or make the original template available to any third party. This restriction does not apply to printing your completed personalized photobook through a professional printing service for your own personal use.
Unless we provide prior written permission, you may not:

•   resell the template;
•   redistribute the template;
•   share download links;
•   sublicense the template;
•   upload the template to marketplaces or template libraries;
•   upload purchased files to publicly accessible cloud storage;
•   modify the template for resale;
•   use any part of the template commercially.

If you use the template in violation of these Legal Terms, your license to use the template may be revoked immediately.

3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Legal Terms; (2) you are not under the age of 13; (3) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Services; (4) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (5) you will not use the Services for any illegal or unauthorized purpose; and (6) your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof). We reserve the right to suspend or terminate access if any information provided is false or misleading.

4. PRODUCTS
All products available through the Services are digital products.
No physical items will be shipped.
Product previews are provided for illustrative purposes only. Minor variations may occur depending on software, monitor calibration, printer settings, paper type, or printing service used.
We reserve the right to discontinue or modify products without prior notice.
Prices may change at any time before purchase.

5. PURCHASES AND PAYMENT
We currently accept payment through:
Stripe (Visa/Mastercard/ApplePay)
PayPal
All prices are listed in U.S. Dollars unless otherwise stated.
Upon successful payment, customers will receive electronic access to their purchased digital product.
Customers are responsible for providing a valid email address capable of receiving download instructions.
If you experience any issues accessing your purchased files, please contact support@tapesacademy.com, and we will make reasonable efforts to assist you.
We reserve the right to refuse or cancel orders that appear fraudulent or violate these Legal Terms.

6. REFUND POLICY
Because our products are digital products delivered electronically, all sales are final.
Once access to the purchased digital product has been provided, the product cannot be returned.
Accordingly, we do not provide refunds, exchanges, or cancellations after delivery, except where required by applicable law.
If you experience a technical issue preventing access to your purchased files, please contact support@tapesacademy.com before requesting a payment dispute. We will make reasonable efforts to resolve download or delivery issues.
Refunds will not be granted because:

•   you changed your mind;
•   you no longer need the template;
•   you purchased the product by mistake;
•   you lack compatible software;
•   you are dissatisfied with your own customization or printing results;
•   Your printing studio does not offer A4 paper size.

7. PROHIBITED ACTIVITIES
You may not use the Services or any purchased digital products in any way that violates these Legal Terms or applicable law.

In particular, you may not:

•   copy, reproduce, or distribute our templates except as expressly permitted by these Legal Terms;
•   sell, resell, sublicense, rent, or commercially exploit any template or any part of it;
•   share purchased files or download links with any third party;
•   upload purchased templates to marketplaces, cloud libraries, file-sharing websites, or other publicly accessible platforms;
•   claim our templates or designs as your own work;
•   remove any copyright or proprietary notices from our products;
•   use our templates to create products intended for resale;
•   attempt to gain unauthorized access to the Services;
•   interfere with the operation or security of the Services;
•   use automated tools, bots, scrapers, or similar technologies to access or collect content from the Services.

Printing your completed personalized photobook through a professional printing service for your own personal use is permitted.

8. USER GENERATED CONTENT
The Services do not allow users to publicly post or upload content.
If you voluntarily send us feedback, suggestions, ideas, testimonials, or other communications, you grant us the right to use such feedback without compensation, unless otherwise agreed in writing.
You remain responsible for ensuring that any photographs or other materials you use with our templates do not infringe the rights of any third party.

9. THIRD-PARTY SERVICES
To deliver digital products, we may use third-party services, including Google Drive or other file hosting providers.
We are not responsible for interruptions, outages, delays, or technical issues affecting third-party services beyond our reasonable control.
Links to third-party websites are provided for convenience only. We do not control or endorse their content, products, or services.

10. SERVICES MANAGEMENT
We reserve the right to:

•   suspend or terminate access to the Services for violations of these Legal Terms;
•   investigate suspected misuse of our Services;
•   remove or restrict access to content where reasonably necessary to protect our rights, users, or the operation of the Services.

11. PRIVACY POLICY
Your use of the Services is also governed by our Privacy Policy, which forms part of these Legal Terms.
By using the Services, you consent to the collection and processing of your information as described in the Privacy Policy.

12. TERM AND TERMINATION
These Legal Terms remain in effect while you use the Services.

Termination of access does not affect our ownership of the intellectual property rights in our templates or any rights or remedies available under applicable law.

13. MODIFICATIONS AND INTERRUPTIONS

While we make reasonable efforts to keep the Services available, we cannot guarantee uninterrupted access.
Temporary interruptions may occur due to maintenance, software updates, internet connectivity issues, or third-party service providers.

14. GOVERNING LAW
These Legal Terms shall be governed by the laws of the United Arab Emirates.
Any dispute arising from these Legal Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates unless otherwise required by applicable law.

15. DISPUTE RESOLUTION
Before initiating legal proceedings, both parties agree to make reasonable efforts to resolve any dispute through good-faith negotiations.
If a dispute cannot be resolved informally, it shall be resolved in accordance with the applicable laws of the United Arab Emirates.

16. CORRECTIONS
We reserve the right to correct any errors, inaccuracies, or omissions in the Services, including product descriptions, pricing, availability, or other information.
We may update or modify information on the Services at any time without prior notice.

17. DISCLAIMER
The Services and digital products are provided on an "as available" and "as is" basis.
We make reasonable efforts to ensure that our templates are accurately described and function as intended. However, we do not guarantee that:

•   the Services will always be available without interruption;
•   files will be compatible with every software program;
•   printed results will match exactly what is displayed on a user's device;
•   third-party printing services will produce results that meet your expectations.

You are responsible for ensuring that you have the appropriate software, equipment, and knowledge required to edit and use the purchased template.

We are not responsible for:

•   printing quality;
•   paper quality or color differences;
•   errors made during customization;
•   issues caused by third-party printing companies;
•   problems caused by incompatible software or devices.

18. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, dasha tapes Design & Artwork Services shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or purchased digital products.
Our total liability for any claim relating to the Services or products purchased from us shall not exceed the amount paid by you for the applicable product.

Nothing in these Legal Terms limits any rights that cannot be excluded under applicable law.

19. INDEMNIFICATION
You agree to protect and hold harmless dasha tapes Design & Artwork Services, its owners, employees, and representatives from claims, damages, losses, or expenses arising from:

•   your violation of these Legal Terms;
•   your misuse of the Services or purchased products;
•   your infringement of third-party rights;
•   your violation of applicable laws.

20. USER DATA
We collect and process certain information necessary to provide our Services, process payments, and deliver purchased products.
You are responsible for keeping your personal information accurate and up to date.
We are not responsible for loss of information caused by circumstances outside our reasonable control.

These Legal Terms do not create any partnership, employment, agency, or joint venture relationship between you and us.
